Kambo's Warehouse – Conditions of Purchase

In these Terms and Conditions "we" and "us" mean Kamb Investments Pty Ltd CAN 008 904 023 ABN 89 361 635 320 Trading As Kambo's Warehouse - 11 Excellence Drive, Wangara 6065, and "you" means you the customer.
These Terms and Conditions together with your Sales Order constitute the entire Contract between you and us for the supply of products. The Contract cannot be varied unless we agree to vary it in writing or by email. Kambo's advises the pictures are for illustration purposes only and therefore may not reflect the correct model specified.

By accepting these terms and conditons you  verify that all information is true and correct. Failure to do so may result in delays to your order.


Privacy Policy

Kambo’s and its franchisees acknowledge the importance of your personal information and that you are concerned with its collection, use and disclosure. This Privacy Policy sets out how Kambo’s uses and protects any information that you give to Kambo’s when you use this website.

Kambo’s is committed to ensuring that your privacy is protected. Any personal information collected by Kambo’s will only be used in accordance with this Privacy Policy.

  1. 1.       The kinds of personal information that Kambo’s collects.

In the process of conducting its business, Kambo’s may collect a wide range of personal information, including but not limited to:

  • Your name;
  • Your address;
  • Your date of birth;
  • Your telephone number(s);
  • Your email address;
  • Payment information;
  • Transaction information;
  • Your user name and password;
  • Details about your earnings (only if you are buying products using a finance plan);
  • Information contained on identification documents (such as driving licences) and, in some specific cases, copies of such identification documents, where Kambo’s requires these to verify your identity;
  • Your IP (Internet Protocol) address, server address, domain name and information on your browsing activity when visiting this website;
  • Your username for social networking sites that you use, to refer to, or in conjunction with, Kambo’s goods and services; and
  • Personal preferences regarding products and services.

 

  1. 2.       How Kambo’s collects and holds personal information

Kambo’s collects personal information in several ways, including:

  • When you order products and services (i.e. extended warranties) from Kambo’s, either online, in-store or over the telephone;
  • When you set up an account with Kambo’s on this website;
  • When you pay for goods by cheque;
  • When you subscribe to Kambo’s mailing list (Club Kambo’s);
  • When you enter competitions or promotions run by Kambo’s;
  • When you provide Kambo’s with your details for customer care purposes;
  • When you browse this website;
  • When you submit an enquiry using this website;
  • When you publicly comment about Kambo’s on social media sites (for example so that Kambo’s can answer questions about its products).

If you are accessing products and services via this website, Kambo’s may use technology to collect information as to your activities, including:

Generally Kambo’s does not collect “sensitive information” (such as information about ethnic origin, religious orpolitical views, health information etc.) from you.

  • “Remarketing with Google Analytics” : this feature allows Google to show you advertisements based on your previous visits to this website.

Kambo’s does not facilitate the merging of personally identifiable information with non-personally identifiable information collected through any Google advertising products or features.

How Kambo’s uses cookies

A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

Kambo’s uses traffic log cookies to identify which pages are being used. This helps Kambo’s analyse data about web page traffic and improve this website in order to tailor it to its customers’ needs. Kambo’s only use this information for statistical analysis purposes and the data is subsequently removed from the system once it is no longer required.

The personal information which you provide to Kambo’s is used to provide goods or services to you, and in particular for the following reasons:

  • To keep an internal record of the transactions between Kambo’s and you;
  • To supply additional products or services which may be of assistance to you (i.e. warranty or customer care plan);
  • To improve Kambo’s products and services;
  • Provided that Kambo’s has obtained your consent to do so, to periodically email to you using the email address provided to Kambo’s, promotional emails about new products, special offers or other information which Kambo’s thinks you may find interesting;
  • To contact you for marketing and research purposes, by email, phone, fax or mail, from time to time. Kambo’s may use the information to customise this website according to your interests.
     
  1. 4.       How and when Kambo’s may disclose personal information which it has collected

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.
     
  1. 5.       How you may access the personal information that Kambo’s holds about you, and how you may seek correction of that personal information.

You may choose to restrict the collection or use of your personal information in the following ways:

  • Whenever you are asked to fill in a form on this website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes; or
  • If you have previously agreed to Kambo’s using your personal information for direct marketing purposes, you may change your mind at any time by either:
    • The “unsubscribe” function provided at the bottom of any emails previously sent to you by Kambo’s; or
    • By visiting Kambo’s in-store or calling Kambo’s in 9208 7555.

Kambo’s will not sell, distribute or lease your personal information to third parties unless required by law to do so or with your authorisation. If you have agreed for Kambo’s to do so, Kambo’s may use your personal information to send you promotional information about third parties which you may find interesting.

Under the Data Protection Act 1998, you may request details of the personal information which Kambo’s holds about you. For most requests, your personal information will be provided free of charge, however Kambo’s may charge a reasonable fee at Kambo’s absolute discretion. Any request for personal information may be made at any Kambo’s store or by calling Kambo’s on 9208 7555.

You may also correct any personal information which is incorrect or incomplete, by using the “Update my personal details” function available when you log in to your account on this website.
 

  1. 6.       Disclosure of personal information to overseas recipients.

Kambo’s may need to disclose your personal information to an “Overseas Recipients” (Third party) for example a database hosted outside Australia, or where you are interacting with a web or mobile application based overseas.

Before disclosing your personal information to an “Overseas Recipient”, Kambo’s take reasonable steps to ensure that the “Overseas Recipient” does not breach the Australian Privacy Principles in relation to your personal information, and must only disclose your personal information to an “Overseas Recipient” for the primary purpose for which that personal information was collected (unless an exception applies under Australian Privacy Principle 6).

The countries to which Kambo’s is most likely to send your personal information include the United States of America, Canada and Ireland.
 

  1. 7.       Significant handling practices used by Kambo’s.

This website may contain links to other websites of interest. However, once you have used these links to leave this website and access other websites, Kambo’s does not have any control over those other websites. Therefore, Kambo’s is not responsible for the protection and privacy of any personal information which you provide whilst visiting such websites and these websites are not governed by this Privacy Policy. You should exercise caution and read the privacy statements applicable to the other websites before providing your personal information to any other party.

Western Australia Sales Only  (Packages under 12KG will be shipped free of charge with Perth metro area only via Australia post)

We only sell and ship large products (Whitegoods, Televisions etc) within Western Australia. We will not make large deliveries outside of Western Australia. Homeware sales exceeding 12KG and being delivered outside of Perth metro will also incur a delivery fee.

Australia Wide Deliveries

We will deliver Homewares Australia wide, homeware sales under $100 will incur a postage delivery fee. Eparcels exceeding 12KG and being delivered outside of WA will incur a postage fee.
 

Legal Capacity To Transact

If you are under the age eighteen (18) years you cannot place Sales Orders with Kambos.
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Should Kambo's suffer any damage or other losses as a result of a transaction entered into by a minor, Kambo's reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Kambo's.
 

Placing Your Order

You may place a Sales Order by following the steps in our shopping cart facitity on the Kambo's Web Site and clicking the "Submit My Sales Order" button.
When you place your Sales Order, we will issue you with a Sales Order Number. 
By placing a Sales Order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions. Information contained on the Kambo's website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any products, however Kambo's will make every effort to supply products to you. Once your Sales Order has been processed we will supply a Tax Invoice with your goods upon shipment or collection; however, we do not formally accept your offer until your Sales Order has passed our internal validation procedures for verifying the sincerity of each Sales Order placed, for the purpose of preventing credit card or payment fraud. Kambo's and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel Sales Orders in their sole discretion. If we cannot process or accept your Sales Order after payment is received we will contact you by email or telephone. A phone number must be provided to effect delivery.
 

Payment Methods And Processing

Kambo's currently accepts BPAY, Visa, MasterCard, Diners and Amex. Please note: a surcharge applies to Diners 3.22% and Amex 2.86%. Payment processing will not begin until we receive all the information we need. 
Sales Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.
Business days are Monday through Friday, excluding WA Public holidays. 
We process credit card payments after you click the "Submit My Order" button. 
Where you pay by BPAY you must pay the price payable in Australian dollars as indicated on your Sales Order Confirmation within 5 days from the date that you receive your Sales Order Confirmation.
If a BPAY payment is not received within 7 days from the date that you receive your Sales Order Confirmation, Kambo's reserves the right to cancel the transaction.

Please Note: We are unable to accept credit cards issued by banks outside of Australia. Debit cards have daily spending limits that may substantially delay the processing of your sales order.
You may be required to provide further identification for additional security reference checks.
 

GST

Kambo's purchases include GST.
 

Prices

Kambo's always seeks to list products with the most competitive prices.
Kambo's reserves the right to change prices for products displayed at Kambo's at any time.
The price of products shown excludes shipping costs.
Shipping cost is shown separately in the shopping cart page but may be recalculated based on how many and what items you place in your shopping cart.
 

Online Products & Prices

Please note that all products advertised online are available in store.  Online pricing may vary in store and we recommend calling either store and verifying the prices to avoid disappointment.  Our online prices are for products purchased online and the same prices may not be reflected or honoured in store.
 

Supply Of Your Products

Subject to these Terms and Conditions, we will supply to you the products indicated on your Sales Order Confirmation.
When your Sales Order items have been dispatched, we will email you to confirm shipment of each item including a tracking number (if applicable) for each item.
 

Delivery Of Your Products

Delivery time takes up to 10 working days from the date your payment is received. Please note that BPAY payments take 1-2 business days to process. 

Kambo's makes every effort to deliver your product according to the estimated delivery times provided by Kambo's at checkout. The estimated delivery times are in business days (Monday through Saturday) excluding Public holidays except by prior arrangement for after hours delivery.
Although every effort is made to ship your Sales Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your product has not arrived after the estimated delivery time, please contact us.
We encourage you to visit the "Your Account" section on our website to view the delivery status of your products.
Unless otherwise agreed by us, we will deliver your products to the address indicated on your Sales Order Confirmation. If no-one is available to take delivery of your products, our carrier (Australia Post eParcel) will leave a card so you can pick-up your product from your local Post Office. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone to arrange a another time and date for delivery, please note a re-dispatch fee will apply.
We will use all reasonable efforts to deliver your products to you within the estimated delivery time indicated on your Sales Order Confirmation; however, we do not guarantee that we will deliver within this time frame.
Title and risk of loss to all products will pass to you on delivery.
 

Gift Wrapping

Gift wrapping is applicable only to small appliances and homewares. Whitegoods, Telvsions and air conditioners will not be wrapped. 
 

Returning A Product / Refunds

Even though at Kambo's, we take pride in the care we take with packing all of our internet and phone orders, sometimes, accidents or errors happen. Notification of faulty, damaged, incorrect or missing products must be received by our Customer Service Department within 48 hours of your parcel being signed for. Should your parcel contain a damaged or faulty item, Kambo's will provide instructions on how to return goods in an appropriate manner.
If the product is damaged or Dead on Arrival or a Later Defect product, we have indicated below what you should do and how Kambo's will respond to the problem.
Kambo's will not provide a refund or replace a product that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to ensure that all instructions and advice or warnings given by the manufacturer or supplier are followed.

Please be aware that we are more then happy to take accountability for faulty or damaged goods. We will not however be held responsible for a change of mind or an incorrect purchase. We are more then happy to provide as much assistance as needed to ensure you choose the right product the first time. Upon Kambo's discretion an in store credit may be offered for your goods however a full refund will not be offered.

Dead On Arrival Products - "DOA”

A Kambo's product is considered DOA if it shows symptoms of a failure, or is discovered to be broken or defective when first taken from its packaging. A Kambo's Customer Service Representative will provisionally determine whether the product is DOA. A photo may be requested to assist with the assessment of your claim. Where a product is provisionally determined as DOA we will arrange a replacement product or a full refund if it cannot be replaced.
A Kambo's product is considered DOA if it shows symptoms of a failure, or is discovered to be broken or defective when first taken from its packaging. A Kambo's Customer Service Representative will provisionally determine whether the product is DOA. A photo may be requested to assist with the assessment of your claim. Where a product is provisionally determined as DOA we will arrange to provide a replacement product.
If the product is deemed by Customer Service NOT to be DOA, and is not covered by a warranty, Kambo's may refuse to replace the product or give you a refund for the product.
When a product is replaced, your replacement product becomes your property and the returned DOA product becomes our property. Replacement products are provided with the same warranty as the returned product.
When a refund is given, the returned DOA product becomes our property.
 

Defect Products

If the product is not DOA and you find that the product has a defect or a problem within the warranty period it is up to the consumer to arrange delivery of the product back to Kambo's. We will assess the fault and take necessary action complying with the relevant manufacturers returns policy.
 

Pricing errors on website

Every so often human error may occur on the website on product pricing, images and specifications. In the event a product is placed on the website at an incorrect price Kambo’s reserve the right to withhold the sale. We will endeavor to ensure all pricing on the website is up to date, true and correct on all products. If an error does occur we will work alongside the consumer to come to a reasonable solution.A contract between the buyer and seller will not be formed until goods are confirmed by the seller by way of a confirmation call.
 

Product Images

Please note some product images on the website are used for illustrative purposes only as not all product images can always be sourced off of the manufacturer or supplier.
 

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia and shall be subject to the non-exclusive jurisdiction of the courts of Western Australia.
 

Online & in store Pricing 

Please note that in store and online pricing may vary. For these instances we do offer the option to purchase online and pick up from either store or for our customer to choose the appropriate delivery method. If unsure on store pricing and considering coming in store please feel free to call 9200 1390 and we will be more than happy to advise the in store price.
 

Fraud Prevention Protocols

Due to an increase in online fraud, Kambo’s have implemented fraud prevention protocols.  At times we may request additional information from you, we may contact you to confirm details or request that you provide identification upon delivery or pick up.  Until your order has passed our fraud prevention protocols your order will not be processed. If we cannot verify your identity within 5 days, your order will be cancelled. These protocols are in place to help protect credit card holders and other customers from online fraud.
